State Law Protection for Business Interests Against Personal Creditors

When choosing a state in which to form your business entity, you need to weigh the relative advantages and disadvantages of the laws in certain states.

Mail Order business

I am interested in knowing what the business model is for the mail order companies that I receive infornation from. One is for general merchandise and the other is for health products, and in either case they use the same format. My experience is that once I order from a company I then am put on other mailing lists and the deluge starts. In the case of the general merchandise the company names are all different but the details are the same, i.e same order blank, same numbering system for goods, same pricing method (reg. price/sale price), same shipping policies, same handling charge, a code no. in the same location on the order blank, etc. Some of the mailings are small or large catalogs and others come in envelopes of 50 or so single sheets. In the case of the health products there are small 6-8 page brochures touting the value of the products, which all have weird sounding names; the same doctor testifies to the value of them, the address is from the state of Illinois, they all have a code number, etc. I am really interested in knowing how that model works and what the code number tells them. Can anyone help me out?

Hazard Communication Program Package for OSHA Compliance

If workers may be exposed to hazardous materials in your workplace, you are required by OSHA to have a written hazard communication program. The program must include not only a list of hazardous chemicals known to be present in the workplace, but also a completed material safety data sheet (MSDS) for every chemical on the list. It must also spell out the method you will use to inform employees of the hazards associated with chemicals and the procedures to be followed with respect to labeling chemicals, updating material safety data sheets, and training employees. The attached file contains two documents designed to help you comply with the requirements. The first is a model written hazard communication program that you can use or modify to build your own program for your workplace. The second is OSHA Form 174, the basic, non-mandatory format developed by OSHA for completing the required MSDS for each hazardous substance on your company's list.

Delaware Rules on Employing Minors

A minor in Delaware may not work unless the employer has a verified and validated employment certificate for the minor. The certificate must be kept on file at all times and be accessible to the Department of Labor on request. Work permits (employment certificates) may be issued by the superintendent of each school district or a designee authorized by the superintendent. The age of the minor must be verified by a certified copy of a birth certificate, baptismal certificate (showing the date of birth), school record, passport, valid driver's license or official government document attesting to the minor's age.

Maryland Rules on Employing Minors

In Maryland, unless an employer possesses a work permit or special permit for a minor, the minor may not work for the employer. Employment certificates will be issued by the Commissioner of Labor and Industry, a county superintendent of schools or a designee of a superintendent of schools upon confirmation of the age of the minor requesting the work permit. The commissioner may issue a special permit to a minor of any age to be employed as a model, performer or entertainer.

Buying Used Vehicles

If you don't want to use a vehicle you already own for your business, there are numerous advantages to purchasing a used vehicle instead of a new one. The main advantage is this: as soon as you drive a new vehicle off of a dealer's lot, it immediately becomes worth much less than the price you paid for it. In fact, it is not unusual for a vehicle with just 10,000 miles on it to be worth several thousand dollars less than a new car of the same model.

OSHA Form 174: Material Safety Data Sheet (MSDS)

Federal law dictates that employers must provide information to their employees about hazardous materials and chemicals that employees may be exposed to in the workplace. The vehicle for that information is the Material Safety Data Sheet (MSDS). While there is no specified format for the MSDS, OSHA has developed a non-mandatory format, OSHA Form 174, which may be used by chemical manufacturers and importers to comply with OSHA's Hazard Communication Standard. You are entitled to receive a data sheet from your supplier.

Model Simplified Employee Pension Plan

A simplified employee pension plan is usually one of the easiest and least expensive ways for a small employer to provide employees with a retirement plan. Although a SEP is generally regarded as one of the simplest forms of retirement plans, it is still subject to complex — and sometimes confusing — regulations. A small business owner is faced with a surprising number of obligations regarding contributions, tax deductions, recordkeeping, employee notification, etc.
